OPINION

STRUBHAR, Judge:

11 Appellant, Charles Frederick Warner, was convicted of First Degree Murder and First Degree Rape, in the District Court of Oklahoma County, Case No. CF-97-5249, after a jury trial held before the Honorable Virgil C. Black. As to the count of First Degree Murder, the State filed a Bill of Particulars alleging two aggravating cireum-stances: 1) that the murder was especially heinous, atrocious or eruel; 1 and 2) the existence of a probability that Appellant would commit acts of violence that would constitute a continuing threat to society.2 The jury found the existence…
