*362 The District of Columbia and the State of Maryland commenced this action against Donald J. Trump in his official *363 capacity as President of the United States and in his individual capacity, alleging that he violated the Foreign and Domestic Emoluments Clauses of the U.S. Constitution. The Foreign Emoluments Clause provides that no officer of the United States shall "accept" any "present, Emolument, Office, or Title ... from any King, Prince, or foreign State." U.S. Const. art.
