Plaintiff brought this action to recover on a promissory note given by defendant to R. R, Hoyt, in the sum of $3,000, dated February 10, 1926, and due one year from date, bearing six per cent interest, with -principal and interest not paid when due bearing interest at ten per cent. The complaint alleges the execution of the note, its purchase by plaintiff before maturity and for a valuable consideration, demand and nonpayment.
