This is an indictment against the appellant, charging, in substance, that he did, on Sunday, the 1 ith day of May, 1873, at, etc., sell two gills of intoxicating liquor to Peter Goth, for ten cents, and suffer and permit the same to be drank in the building and upon the premises where sold. There was a motion to quash the indictment made and overruled, to which ruling the defendant excepted. Upon plea of not guilty, and a trial by the court, the defendant was found guilty. He moved for a new trial and in arrest of j udgment, both of which motions were overruled, and he again excepted. There…
