The life beneficiary of this testamentary trust is a patient in the petitioner nursing home. The Department of Social Services has terminated her Medicaid benefits and the corporate petitioner on notice to the two trustees, the Department of Social Services and the remaindermen here seek a determination as to the validity, construction or effect of the testamentary trust provisions.
