But for the current state of the law, I would dissent. Given our present jurisprudence in this circuit, however, I agree with the result my colleagues reach and accordingly respectfully concur. 1 I write separately to express my disagreement with our jurisprudence, which stems from what I consider to be an improperly and inadequately developed state of the law for treating childhood criminal behavior. It is time for a change in our jurisprudence that would Heal with petty crimes by minors in a more enlightened fashion and would not automatically extend qualified immunity…
