Lee Morris was shot and killed on August 23, 1926, and the present suit is by Mrs. Tessie Morris, as widow, acting for herself and her three minor children. to recover compensation under the Employer’s Liability Act, from the defendants . in whose employ Lee Morris was at the time of his death.

It appears that another suit on the same cause of action, was also brought against the defendants by Mrs. Tom East, who also claims to be the lawful widow of Lee Morris, but that cause it not pending in this Court, and therefore it requires no expression of opinion on our part as to its merits.
