Exceptions 3, 4, 5, and 6 were taken to tbe refusal of tbe judge to nonsuit tbe State at tbe close of tbe State’s evidence, and again at tbe close of all tbe evidence.
Tbe defendants were tbe wife and tbe daughter of tbe prosecuting witness, Lutber Alderman. It appeared tbat on 14 April, 1921, tbe defendant, tbe daughter, Christiana, prepared tbe breakfast of her father, Lutber Alderman, who was working on tbe farm of John Murphy, not very far from bis own home.
