DUNCAN, Justice.

On September 13, 1951, appellees filed this action in the lower court against' the appellant, Homer "B. Royse, and J. Porter Land, Clerk of the Fayette County Court, by which they sought'to enjoin the clerk from placing the name of Royse upon the official ballot as a candidate for city commissioner of the city of Lexington to be voted for at the regular November, 1951, ¡election. It was-alleged .that appellant’s nominating petition contained a large number of fictitious names as well as a number of signatories who were not legal voters of the city of Lexington.
