The issues before the Court are whether the Court should sever, abstain from hearing, and remand certain claims in an action removed to this Court from the Circuit Court of Arkansas County, Arkansas. The matter was heard on April 2, 2015. After the hearing, the Court took the matter under advisement. For the reasons stated below, the Court will sever Counts II and III from Count I, abstain from hearing Counts II and III, and remand Counts II and III to the Circuit Court of Arkansas County, Arkansas.
