Error to Circuit Court, Davison County. Hon. Frank B. Smith, Judge. Herman Edward Vey was convicted of murder, and he brings error.

Having been convicted of murder and sentenced to imprisonment for life, defendant brought the record of such conviction to this court for review by writ of error.

It was charged that the defendant killed an unknown man in the city of Mitchell on July i6„ 1906, either with a premeditated design to effect the death of the person killed, or without such design while committing the crime of robbery.
