Appeal 'by defendant from a judgment of the former County Court, Kings County, rendered June 12, 1962 after a jury trial, convicting him of manslaughter in the first degree, and sentencing him as a second felony offender to serve a term of 10 to 30 years. Judgment reversed on the law and a new trial granted. The findings of fact implicit in the jury’s verdict are affirmed. Although the testimony adduced was conflicting as to whether the defendant committed the act of which he was accused, the evidence was more than ample to support the jury’s verdict and an affirmance would ordinarily be…
