Plaintiff Bell Atlantic Tricon Leasing Corporation (“Tricon”) has moved pursuant to Rule 56 of the Federal Rules of Civil Procedure for summary judgment on its claim against defendant Pacific Contracting Corporation (“Pacific”), Robert Schmidt (“Schmidt”) and Kenneth Saas (“Saas”), and for costs and attorneys’ fees on this motion.
