OPINION OF THE COURT. At December term, 1837 [Case No. 11.114], • this case was before the court on pleas in bar,'filed by the defendants, Oliver and Williams. These pleas were overruled, and answers being filed, the case now stands on its merits. In the summer of 1817. the complainant, in connexion with John H. Piatt, William M.
