Plaintiff-Appellant Tennessee Department of Employment Security (appellant) brought this action against defendant-ap-pellee Secretary of Labor (Secretary) under the Comprehensive Education and Training Act, 29 U.S.C. §§ 801 et seq., repealed by Act of October 13,1982, Pub.L. No. 97-300, Title I, § 184(a)(1), 96 Stat. 1357 (CETA), and its successor act, the Job Training Partnership Act, 29 U.S.C. §§ 1501 et seq.
