FUNDERBURK, Justice.

Appellee James Shaw, banking commissioner, has filed a motion to dismiss this suit upon the ground that this court is without jurisdiction because the city of Munday, appellant, has filed no appeal bond and is not exempt by law from filing such bond. The authorities cited in support of the motion are: City of Wink v. R. B. George Machinery Co. (Tex. Civ. App.) 58 S.W.(2d) 555, Midland County v. Slaughter (Tex. Civ. App.) 118 S. W. 762, R.
