This case comes into this court on appeal from the decision of the common pleas court. The plaintiff seeks injunctive relief to restrain the defendants from using a certain trademark known as “Myrod,” and from using the corporate name the “Myrod Shoe Company,” in connection with their shoe business, upon these two grounds:(a) To prevent the violation of a written contract granting to plaintiff the continued and exclusive future use of a certain trade name known as “Myrod.”(b) To prevent unfair competition.
