In a proceeding pursuant to CFLR article 78 to review so much of a determination of the Zoning Board of Appeals of the Town of Islip, dated September 30, 2003, made after a hearing, as denied that branch of the petitioner’s application which was to establish a legal nonconforming use of his property as a mulching/recycling business, including outdoor storage of certain materials, the petitioner appeals from a judgment of the Supreme Court, Suffolk County (Henry, J.), entered December 22, 2004, which denied the petition and dismissed the proceeding.
