This case raises the question of whether it is reversible error for the trial court to fail to give a final instruction on the burden of proof in a negligence action when requested by one of the parties to do so. Michael G. Peak (Appellant-Defendant below) seeks transfer after the Court of Appeals affirmed judgment in favor of Alice and Jeffrey Campbell (Appellees-Plaintiffs below) in their negligence action against Peak.
