WIEAND, Judge.
Joseph C. Shoup was tried by jury and was found guilty of homicide by vehicle while driving under the influence of alcohol, 1 driving while under the influence of alcohol, 2 and homicide by vehicle. 3 The trial court, sitting as fact finder, found Shoup guilty also of the summary offense of reckless driving. 4 Post-trial motions were denied, and Shoup was sentenced to serve a term of imprisonment for not less than three and one-half (34A) years nor more than seven (7) years and to pay a fíne in the amount of one thousand ($1,000.00) dollars. 5 On direct appeal from the judgment…
