Plaintiff and' defendant were residents of the city of Duluth. They Avere married April 29, 1916, and were divorced January 31, 1928. Defendant had deserted plaintiff and was living in the city of Chicago, Illinois, at the time of the divorce. They have two children, William Francis born December 3, 1919, and James Cornelius born May 30, 1923. Pursuant to a stipulation between the parties the decree of divorce gave the custody of the children to plaintiff but gave defendant certain privileges in respect to them which Avill be stated later.
