1. This was an indictment under section 4428 of the Code. The first ground of error is to the judgment of the Court in overruling the demurrer to the indictment. The indictment charges that Thomas Bryan, in the year 1870, did unlawfully employ the servant of one Philip West during the term for which he was employed; that the servant was then in the employment of West, and that his term of service was not expired. In the opinion we entertain of this question we are satisfied that the offense is sufficiently averred. It is charged in the language of the Code. And, while…
