Gary Lynn Baker (“Movant”) was convicted by a jury of the class C felony of possession of a chemical with the intent to create a controlled substance in violation of Section 195.420, 1 and was sentenced, as a prior and persistent offender, to twenty years imprisonment. The judgment was affirmed on direct appeal in State v. Baker, 103 S.W.3d 711 (Mo. banc 2003).
