Sheldon, District Judge.

Herbert R. Tyler, Jr., accompanied by his wife, Bethel Catherine Tyler, was driving his Ford automobile west on U. S. Highway 30 approximately 52 miles west of Rock Springs, Wyoming, when he became involved in a three-vehicle accident at about 9:00 a.m. on March 20, 1952.

The Ford was being followed at a short distance by a large Mack tractor-trailer unit owned by Rulon Jensen of Ogden, Utah, and doing business as Rulon Jensen Trucking Company. Martin D. Klinke, designated as driver, and Lester C. Dunn, designated as alternate driver, were employee-operators of…
