¶ 1. A Lauderdale County jury convicted James Robert Delker of felony DUI as a habitual offender pursuant to Mississippi Code Annotated section 99-19-81 (Rev. 2007).1 The Lauderdale County Circuit Court sentenced him to five years in the custody of the Mississippi Department of *312Corrections (MDOC).
