FACTS AND PROCEDURAL HISTORY
¶ 1. Raymond J. Greer was convicted of capital rape and sentenced to life imprisonment in the custody of the Mississippi Department of Corrections. This Court affirmed the conviction in Greer v. State, 818 So.2d 352, 354 (¶ 1) (Miss.Ct.App.2002) (Greer I). Greer filed an application to proceed in the Hancock County Circuit Court with the Mississippi Supreme Court.
