FISHER, Chief Justice.

— This is a suit by Smith against the telegraph company for damages for failure to promptly deliver a message announcing the fact that his father was dangerously sick, and in a critical condition. Verdict and judgment below went in favor of* the plaintiff for $500, from which judgment the telegraph company has appealed.
