Appeal by the relator, Edwin C. Remington, from an order of the Supreme Court, made at the Monroe Special Term and entered in the office of the clerk of the county of Monroe on the lltli day of March, 1898, denying his application for a peremptory writ of mandamus.

This special proceeding was begun January 27, 1898, by the service of an order requiring the defendants to show cause why a mandamus should not issue out of and under the seal of this court, directed to and commanding them as such town board to forthwith convene and make a certificate to the effect that the account of Edwin C.
