STANIFORTH, J.

After a nine-month trial, the jury convicted Donald Eugene Skelton, James Evan Mack and John Richard Curtin (appellants) of multiple counts of grand theft (Pen. Code, § 487, subd. 1), sale of unqualified securities (Corp. Code, § 25110), securities fraud (Corp. Code, §§ 25401, 25541), and conspiracy to commit grand theft (Pen. Code, §§ 182, subd. 1, 487, subd. 1).

Before trial, the court denied defense motions to suppress evidence, to set aside the indictment for failure to comply with statutory procedures and a Johnson (Johnson v. Superior Court (1975) 15 Cal.3d 248, 255…
