ORDER GRANTING MOTION TO DISMISS

LEWIS M. KILLIAN, JR., Bankruptcy Judge.

THIS MATTER is before the Court on the Motion to Dismiss filed by Don Rein-hard (the “Motion,” Doc. 9). The parties have agreed to treat Mr. Reinhard’s Motion as a motion for partial summary judgment as to Count I of the complaint, which alleges that the Debtor is limited to exempting $125,000 in his homestead real property pursuant to 11 U.S.C. § 522(p) (2006). The issue presented is whether or not the $125,000 cap applies where a residence owned for more than 1215 days before the filing of the petition acquires…
