— This was an action for damages sustained by the appellee resulting from alleged fraudulent acts of the appellant whereby the appellee lost a large sum of money in a real estate transaction. The controlling facts are not greatly in dispute. The cause was tried before a jury upon an amended complaint to which was addressed a general denial, resulting in a verdict in favor of the appellee in the sum of $10,500.00. The appellee filed a remittitur in the trial court in the sum of $125.00 whereupon judgment was rendered for him against the appellant in the sum of $10,375.00. The appellant…
