Raymond Lindsey, an Arkansas inmate, appeals from the District Court’s 1 order granting summary judgment to members of the Arkansas Parole Board (Board or Parole Board) on Lindsey’s claim filed under 42 U.S.C. § 1983. We remand the case to the District Court with instructions to *97vacate its order and dismiss the action without prejudice.
