Court of Criminal Appeals of Oklahoma
Appeal from Ottaiva County Cowgt; W. Y. Quigley, Judge. Walter Tydings was convicted of violating the prohibition law and sentenced to pay a fine of $500 and to be imprisoned in the county jail for a term of 180 days, and he appeals.

RICHARDSON, Judge.
The state has filed a motion to dismiss this appeal on the ground that plaintiff in error is a fugitive from justice, and is not now where he can be made to respond to any order or judgment which may be made or rendered in this court.
