FLANAGAN, Chief Judge.
This matter is before the court on parties’ cross-motions for judgment on the pleadings [DE # 9, DE# 12]. Pursuant to 28 U.S.C. § 636(b)(1), United States Magistrate Judge Christina L. Demory entered a memorandum on November 29, 2004, recommending that the court deny defendant’s motion, grant plaintiffs motion, and remand the case to the Commissioner for further findings.
