This suit involves a challenge to the Department of Labor’s regulations interpreting Title II, Section 231 of the Trade Act of 1974 (“the Act”), as amended in 1981 by P.L. 97-35, 19 U.S.C. § 2291 (1982), provisions governing worker eligibility for Trade Adjustment Assistance (TRA). This lawsuit was filed originally by officers of the Maine Department of Labor and Bureau of Employment Security.
