This matter is before the Court on Defendant’s 1 Motion to Dismiss for Lack of Subject Matter Jurisdiction. For the reasons set forth below, Defendant’s Motion to Dismiss is GRANTED.

I. OVERVIEW

On or about July 9, 2009, Juan Gonzalez (“Juan”) d/b/a Gonzalez Grocery (collectively “Plaintiff’) filed a Complaint against Thomas Vilsack, Secretary of the United States Department of Agriculture, and the United States (“Defendant”).
