I. INTRODUCTION

Ricky J. Turco appeals his conviction and sentence for third-offense driving while under the influence of alcoholic liquor or drugs in violation of Neb. Rev. Stat. § 60-6,196 (Reissue 1993). He appealed to the district court, claiming, among other things, that the county court erred in denying his motions to hire an expert witness and to exclude the breath test result, that the jury had insufficient evidence on which to base its finding of guilt, and that his sentence was excessive.
