Appeal by the defendant, Charles S. Hanna, from a judgment ®f the Supreme Court in favor of the' plaintiff, entered in the office of the clerk of the county of Washington on the 25th day of September, 1905, upon the verdict of a jury rendered by direction-of the court after a trial at the Washington Trial Term, and. also from an order entered in' said clerk’s office on the 25th day of September, 1905, denying the defendant’s motion for a new trial made upon the minutes.

Cochrane, J. :

On the 2.8th day of February, 1908, the trustees of a religious corporation incorporated under the name of “ The Trustees of the Associate Presbyterian Congregation of Hebron ” executed to the defendant a deed purporting to convey to him real estate of said corporation. The consideration for such conveyance was paid' by the defendant to the said trustees and by them applied to the purposes of said corporation, and the defendant went into possession of the property described in said deed.
