delivered the opinion of the court:

The defendant, Clarence Wright, was indicted for the offenses of felony theft and possession of a burglary tool, a key. He was tried before a jury and was found guilty of felony theft and not guilty of possession of the burglary tool. A sentence of not less than 1 nor more than 5 years in the penitentiary was imposed and the defendant appeals. Upon this appeal, defendant contends that the evidence was not sufficient to prove his guilt beyond a reasonable doubt. We agree.
