Plaintiff sues to recover the sum of $10,000 on two bonds, executed respectively in sums of $5,000 each on November 15, 1904, and January 16,1904, by the defendant and the defendant’s testator. The bonds were furnished by the defendant and the defendant’s testator because the city of New York refused to pay the defendant’s testator’s salary for the years 1904 and 1905 unless the defendant and the defendant’s testator agreed to reimburse the city in case the city should subsequently be required to pay *605the same salary again to the plaintiff herein.
