This is an appeal from a judgment rendered upon a general demurrer to plaintiff’s petition, and. the only question presented for our consideration is, whether the petition states facts sufficient to constitute a cause of action.

Such parts of the petition as are deemed of special importance by the parties are set out literally; other parts are set out in substance only. The facts stated are as follows: The defendant sold some machinery to one, Thomas W.
