I must dissent from the opinion because I am thoroughly convinced that the court by misconstruction of the contract between the city of Newport and the telephone company has relieved the telephone company of a material obligation that it voluntarily entered into a contract with the city to perform, and has put on users of telephones in the city a burden in the way of an extra telephone fee they should not be required to bear.
