ROGERS, Circuit Judge:

This is an appeal from the dismissal of a complaint for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). For the following reasons, we reverse.

The Financial Institution Reform, Recovery, and Enforcement Act (“FIRREA”) governs the disposition by the Federal Deposit Insurance Corporation (“FDIC”) of claims against failed banks for which it is acting as receiver.
