On February 17, 1930, John Whalen died. On February 18,1930, defendants, John W. Vincent and Susan E. Brentano filed a petition in the county court of Yamhill county, Oregon, for the appointment of said defendant, Susan E. Brentano, as administratrix of the estate of said John Whalen, deceased. In said petition, it was stated, among other things, that defendant, Susan E. Brentano, was a niece, and defendants, John W. Vincent and James M.
