MEMORANDUM OPINION AND ORDER

COLLINSON, District Judge.

This is an action for judicial review of a final decision of the defendant Secretary of Health, Education and Welfare (the “Secretary”) that plaintiff is not entitled to disability insurance benefits under Title II of the Social Security Act, 42 U.S.C. § 401 et seq. (1974). Plaintiff filed a brief in support of his claim for benefits on August 29, 1979. The Secretary moved for summary judgment on September 18, 1979.
