(after stating the facts). It is first sought to uphold the decree on the ground that the plaintiff was entitled to the 280 acres of land in controversy, or the proceeds thereof, after the death of Mrs. Eliza P. Hall, which occurred in October, 1924. This contention is made under the provisions of § 3 of the will of John B. Hall, which is copied in our statement of facts, and need not be repeated here.
