Affirming.

Prior to the year 1913, the Bond-Foley Lumber Company, hereinafter called the lumber company, owned a large area of timber land in Jackson county. Individual members of this company organized a corporation known as the Rockcastle River Railway Company, hereinafter called the railway company, and during the years 1913 and 1914 acquired by purchase from various landowners a right of way 40 feet in width from East Bernstadt in Laurel county to Bond in Jackson county, a distance of about 16 miles.
