Affirming.
This appeal is the result of the dismissal of petitions, original and intervening, filed by appellants in consolidated actions in the Franklin Circuit Court, seeking by mandamus and mandatory injunction- to compel the Secretary of State to accept petitions signed by the requisite number of voters nominating appellants as independent candidates for the office of circuit judge, and to compel him to certify their names to the proper county officials in order that they might be printed on the official ballot for the 1939 general election.
