The petitioners allege, that in the month of May, 1841, they pur chased, through Holt & Arrowsmith, their agents in New Orleans, of the defendants, 1215 bales of cotton, weighing 544,312 pounds, at the price of nine and a half cents per pound. That the purchase was made by samples drawn from *6said bales, whereby the vendors, by implication of law, warranted the quality of the cotton contained in said bales, to be at least equal to that qf the samples drawn from them, and that a sound price was paid for said cottqn, on the said implied warranty.
