Appeal by the defendant from a judgment of the Supreme Court, Kings County (Heller, J.), rendered July 14, 1986, convicting him of criminal possession of stolen property in the first degree, unauthorized use of a vehicle in the third degree, reckless endangerment in the first degree, and criminal mischief in the third degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, as a matter of discretion in the interest of justice, by reversing the conviction for criminal mischief in the third degree, vacating the sentence imposed thereon, and dismissing that count…
